Fence rules in Richmond

Permit
Richmond requires a fence permit for any fence that abuts or can be seen from a street, including repairs to it. Fences along interior side or rear lines that do not abut a street are exempt. Apply through the City's MGO portal.
Height and placement
Front-yard fences up to 42 inches (6 feet for steel tubular or wrought iron); side and rear fences up to 6 feet (6.5 feet for wood with a kick board). The finished side faces the street. Chain link only where it cannot be seen from the street.

Many Richmond addresses are outside city limits. Pecan Grove lies wholly in Richmond's extraterritorial jurisdiction, and most Veranda sections pay no City of Richmond tax. Outside the city, Fort Bend County Engineering issues development permits, and any work in a mapped floodplain needs one.

Ground and weather

  • Soils change sharply across Richmond. City Hall sits on well-drained Kenney loamy fine sand, while the Brazos floodplain east of downtown has Pledger and Brazoria clays that the USDA rates very limited for building because of shrink-swell and flooding. Pledger clay cracks 20 to 50 inches deep when dry, so check your own lot before choosing post depth.

  • The Brazos River at Richmond set its record of 55.19 feet during Harvey in 2017, after 54.74 feet in June 2016; major flood stage is 50 feet. Several Richmond-area communities, Pecan Grove among them, sit behind levees run by special districts.

  • Hurricane Beryl in July 2024 brought down trees and damaged homes across Fort Bend County, with a 76 mph gust measured at Sugar Land airport, the county's highest reading. The county was part of the federal disaster declaration.

HOA fence rules we have read

Only communities that publish their rules. HOAs update them, so ask yours for the current version and get approval before you build.

Del Webb Sweetgrass

ACC application to install, change, move or remove a fence, plus a neighbor notification form. Fences are black metal (powder-coated aluminum or steel) with square pickets up to 48 inches. No chain link or electric fences.

Pecan Grove

A replacement, a new location or a golf course fence needs an architectural application; a repair does not. Wood fences may be 6 ft 6 in including a 6-inch rot board; wrought iron on the golf course is 4 feet.

Questions from Richmond homeowners

Do I need a permit to stain or paint my new fence in Richmond?

Inside city limits, yes, if the fence faces or can be seen from the street. Richmond's code requires a fence permit when a new fence or segment is stained or painted, when materials or colors change, when the height or layout changes and when a driveway gate is added. Permits go through the City's MGO online portal.

My address says Richmond but I'm outside city limits. Who regulates my fence?

Mostly your HOA's recorded rules. Fort Bend County Engineering issues development permits in unincorporated areas; its list names structures of 400 square feet or more, fill and grading, and any work in a mapped floodplain, not fences as such. In a regulatory floodway, the county prohibits fencing that would affect water flow unless an engineering study shows it does not.

Can I run my fence across a drainage easement?

Not without approval. Fort Bend County's standard plat notes require drainage easements to be kept clear of fences, Richmond's code says fences must not obstruct drainage courses, and Texas law lets an HOA prohibit fencing that blocks a drainage easement. For levee or district easements, ask the district first.

Storm knocked your fence down?

Leaning posts, missing pickets, fences on the ground. Choose storm damage in the form so the request goes to the front of the line.

What makes Houston fences different

01

Clay soil that moves

Much of the area sits on expansive clay that swells when wet and shrinks in drought. Post depth, concrete and steel posts make the difference.

02

Storm season

Hurricanes and tropical storms bring wind that flattens weak fences. After Hurricane Beryl in 2024 many homeowners waited weeks for repairs.

03

Humidity and termites

Wet air and termites shorten the life of untreated wood. Sealed cedar, vinyl and aluminum last longer.

04

HOAs and deed restrictions

With no city zoning, fence rules in Houston usually come from HOAs and deed restrictions. Check them before you build.
