Fencing in Cypress

Cypress is unincorporated Harris County, and most fence rules come from the neighborhood's HOA rather than a city. New-construction communities often need a first fence or an upgrade from the builder's fence.

Fence rules in Cypress

Permit
Unincorporated Harris County does not require a permit for a residential fence outside the flood hazard area. Inside the floodplain a fence counts as development and needs a county permit.
Height and placement
With no county zoning, height and style rules come from your HOA or deed restrictions.

HOA fence rules we have read

Only communities that publish their rules. HOAs update them, so ask yours for the current version and get approval before you build.

Cypress Creek Lakes

Standard fence is 6-foot, three-rail wood with treated cedar pickets, finished side toward anything public. Corner lots get an upgraded fence with cap and trim. Lots on a lake or detention area use 6-foot tubular steel at the back. These are the 2012 builder guidelines; ask the HOA for current resident rules.

Questions from Cypress homeowners

My backyard backs onto a flood control ditch. Can I move my fence back to the channel?

Not without permission. A fence on Harris County Flood Control District right-of-way without authorization is an encroachment. To build or rebuild a fence next to or into the right-of-way, send a written request to the district's Property Management Department with your address, location and channel name, and work from an up-to-date survey.

Can my Cypress HOA ban a backyard fence?

No. Texas Property Code §202.023 says an HOA may not enforce a rule that prevents a perimeter fence. It can still regulate the type of fencing and, if the covenants say so, ban fences in front of the house. Fences built before September 1, 2025 may stay.

Can my HOA stop me from putting a mesh safety fence around my pool?

Not if it is a conforming pool enclosure: transparent mesh or clear panels in metal frames, no taller than 6 feet and not climbable. The HOA may regulate color, but it cannot prohibit a black mesh enclosure in metal frames (Texas Property Code §202.022).

Storm knocked your fence down?

Leaning posts, missing pickets, fences on the ground. Choose storm damage in the form so the request goes to the front of the line.

What makes Houston fences different

01

Clay soil that moves

Much of the area sits on expansive clay that swells when wet and shrinks in drought. Post depth, concrete and steel posts make the difference.

02

Storm season

Hurricanes and tropical storms bring wind that flattens weak fences. After Hurricane Beryl in 2024 many homeowners waited weeks for repairs.

03

Humidity and termites

Wet air and termites shorten the life of untreated wood. Sealed cedar, vinyl and aluminum last longer.

04

HOAs and deed restrictions

With no city zoning, fence rules in Houston usually come from HOAs and deed restrictions. Check them before you build.
