Fence rules in Cinco Ranch

Permit
Cinco Ranch is unincorporated, mostly in Fort Bend County. Fort Bend County's permit list does not name fences, but any work in a floodplain needs a development permit ($150). In the Harris County part, no permit is needed for a residential fence outside the flood hazard area.
Height and placement
The Cinco Ranch HOA sets fence style, height and stain color, so get its approval first.

Questions from Cinco Ranch homeowners

My neighbor and I want to replace our shared fence. Who has to apply?

In Cinco I, both owners must submit an ARC application, and it must come from the owners, not the contractor. In Cinco II, no one may remove a section of a good-neighbor fence without written permission from the neighbor and the association.

Can my Cinco Ranch HOA fine me over a worn-out fence?

The Cinco I guidelines require owners to repair warped, broken or deteriorated parts. Under Texas Property Code §209.006, before fining you the HOA must send notice by certified mail and give you a reasonable time to fix a curable violation, and if you fix it in time no fine may be charged.

Can I stain my Cinco Ranch fence a darker color?

Not without approval. Cinco I allows no paint or stain unless approved, only listed clear sealants. Cinco II (2023) allows a pigmented sealant or stain only if it is similar to the original and the DRC approves it. Check your association's current guidelines before you buy stain.

Storm knocked your fence down?

Leaning posts, missing pickets, fences on the ground. Choose storm damage in the form so the request goes to the front of the line.

What makes Houston fences different

01

Clay soil that moves

Much of the area sits on expansive clay that swells when wet and shrinks in drought. Post depth, concrete and steel posts make the difference.

02

Storm season

Hurricanes and tropical storms bring wind that flattens weak fences. After Hurricane Beryl in 2024 many homeowners waited weeks for repairs.

03

Humidity and termites

Wet air and termites shorten the life of untreated wood. Sealed cedar, vinyl and aluminum last longer.

04

HOAs and deed restrictions

With no city zoning, fence rules in Houston usually come from HOAs and deed restrictions. Check them before you build.
